1. Acceptance of Terms

By accessing or using the FinCore OS platform (“Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you and FinCore Ltd (“FinCore”, “we”, “us”, or “our”).

2. Services Description

FinCore OS is a white-label remittance operating system that enables businesses to launch and operate cross-border payment and remittance services. The Platform provides payment processing, compliance tooling, multi-currency support, payout integrations, and merchant management capabilities.

3. Account Registration

To use the Platform, you must register an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.

4. Transfers & Payments

Transfers and payments initiated through the Platform are subject to availability, applicable limits, and verification requirements. We reserve the right to delay, suspend, or refuse any transaction where we have reasonable grounds to believe it may be fraudulent, unlawful, or in breach of these Terms.

Once a transfer has been submitted and confirmed, it may not be cancellable. Delivery times depend on the payout method, destination country, and partner processing times.

5. Fees & Exchange Rates

Fees and exchange rates are displayed before you confirm each transaction. Exchange rates are indicative and may fluctuate between the time a quote is provided and the time the transaction is processed. We reserve the right to modify our fee structure with reasonable prior notice.

6. KYC/AML Compliance

You agree to comply with all applicable Know Your Customer (KYC) and Anti-Money Laundering (AML) requirements. This includes providing valid identification documents and any additional information we may request to verify your identity or the source of funds. Failure to comply may result in account suspension or termination.

7. Prohibited Activities

You agree not to use the Platform to:

  • Engage in money laundering, terrorist financing, or any illegal activity.
  • Process transactions on behalf of undisclosed third parties.
  • Circumvent or attempt to circumvent transaction limits or verification requirements.
  • Interfere with, disrupt, or compromise the security or integrity of the Platform.
  • Use the Platform in any manner that violates applicable laws or regulations.
  • Reverse-engineer, decompile, or disassemble any part of the Platform.

8. Limitation of Liability

To the maximum extent permitted by law, FinCore shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform. Our total liability for any claim arising under these Terms shall not exceed the fees paid by you to FinCore in the twelve months preceding the claim.

We do not guarantee uninterrupted or error-free operation of the Platform, and we shall not be liable for delays or failures caused by circumstances beyond our reasonable control.

9. Intellectual Property

All content, trademarks, logos, software, and technology comprising the FinCore OS platform are the exclusive property of FinCore Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Platform in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

10. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. You may close your account at any time by contacting us. Upon termination, any pending transactions may be completed or cancelled at our discretion, and you remain liable for all obligations incurred prior to termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Platform. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
